1. Terms of Use

   Please read this legal notice carefully before using AlaskaNativeHire.com. This website is owned and operated by Alaska Native Hire, LLC (“ANH”). This notice contains the Terms of Use (“Terms” or “Terms of Service”) for use of this website (“Site”). This Site is defined as any website under AHN’s control, whether partial or otherwise and the services provide through any such website. These services (“Services”) may include, but are not limited to, allowing users of the Site to create individual profiles, which may include personal information (”Profiles”), and to make these Profiles, or aspects thereof, public; on-line services to post and search employment opportunities; and professional and personal networking among users of the Site.

   By using this Site you agree to be bound by the terms of this legal notice (“Terms” or “Terms of Service” or “Agreement”). These Terms are a binding agreement between you (the terms “You,” “Your,” “Yours,” and “User” as used in this Agreement refer to all individual and/or entities accessing this Site for any reason) and ANH. Each time You use this Site, You are deemed to have accepted these Terms of Service. These Terms will remain in full force and effect while You are a User of the Site. ANH may change these Terms at any time and without any notice to You by updating this Term of Service.

   You must be 18 years of age, or of the age of majority as defined in Your jurisdiction, to use the Site. If You are under 18 years of age, or under the age of majority in Your jurisdiction, You must use the Site under the supervision of a parent or legal guardian. User agrees to be bound by any legal obligations incurred as a result of User’s supervision of minors who use the Site.

   By using the Site, You indicate that You understand and intend these Terms to be the legal equivalent of a signed, written contract and that you accept such Terms and agree to be legally bound by them. If You do not accept these Terms, You are not granted permission by ANH to access or use the Site. Do not use the Site. At its sole discretion, Users who violate these Terms may have their access to and/or use of the Site suspended or terminated without notice by ANH.

   This Agreement provides You with a personal, revocable, nonexclusive, nontransferable license to use the Site, subject to the Terms. The contents of the Site are protected under copyright, trademark and other laws and are the property of ANH or its licensors. Additionally, the compilation of all content on the Site is protected by copyright, trademark, and other laws. Unauthorized use of the Site’s content may violate these laws and is strictly prohibited. You may print and download materials and information from the Site provided that all downloads and hard copies contain all copyright, trademark or applicable notices contained in such material.

   Notwithstanding the aforementioned and except as otherwise expressly permitted herein, You agree not to sell, transfer, distribute, display, modify, copy, broadcast, or otherwise use in any way material or information obtained from or through the Site.

   Any code created by ANH in connection with the development or operation of the Site including the display of its contents or webpages is also protected by ANC’s copyright. You may not copy or adapt such code.

   The Site may be used only by individuals seeking employment and/or career information and by employers seeking employees. The use of the Site, including the Profile database (“Database”) and other features, will by their nature result in the release of Your personal data to other Users of the Site. For example, when You enter personal information in the Profile Database, this information will be available to other Users.

   You are responsible for maintaining the confidentiality of Your account, Profile and passwords. Whether or not authorized by You, You are responsible for all uses of Your account, Profile and passwords. You agree to immediately notify ANH of any unauthorized use of Your account, Profile, or passwords.

   You are prohibited from violating or attempting to violate the security of the Site, including but not limited to:

   • Accessing data not intended for such user or logging into a server or account which the User is not authorized to access
   • Attempting to probe, scan or test the vulnerability of the Site, a system or network or to breach security or authentication measures without proper authorization
   • Transmitting, posting, distributing, storing or destroying the Site’s material, violating any applicable law or regulation
   • Reverse engineering or decompiling any parts of the Site
   • Attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, "flooding", "spamming", "mailbombing" or "crashing
   • Using the Site for any unlawful purpose or any illegal activity
   • Posting or submitting any content, Profile, resume, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, or harassing to any person as determined by ANH’s discretion

   Violations of these or other security measures may result in civil and/or criminal liability.

   You agree that:

   • ANH reserves the right to offer ANH services and products to You, as well as third party services and products to You, based on Your registration to the Site. You agree to receive such offers as may be made by ANH or by third parties.
   • ANH does not represent or guarantee the truthfulness, accuracy, or reliability of information posted to the Site by any User. You acknowledge that any reliance on material posted by other Users will be at Your own risk.
   • You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your ANH account or Your ANH account is terminated, all Your account information will be removed from any public area of the Site. Information may continue to be available for some period of time because of delays in propagating such deletion through ANH’s web servers. In addition, third parties may retain saved copies of Your Information.
   • ANH reserves the right to delete Your account and all of Your Information after a significant duration of inactivity.
   • You understand that the accuracy of all information submitted, posted or displayed by You on or through the Site ("User Content") is Your sole responsibility.
   • By submitting, posting or displaying User content on or through ANH, you grant ANH a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, adapt, distribute and publish such User Content through ANH.
   • ANH reserves the right to refuse to accept, post, display or transmit any User content in its sole discretion.
   • The Site contains links to third party websites. These links are provided solely as a convenience to You and not as an endorsement by ANH of the contents on such third-party Web sites. ANH is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third-party websites, You do so at Your own risk.

2. Additional Terms Applicable to Employers

   Employers are solely responsible for their searches of and postings to the Site. ANH is not to be considered to be an employer with respect to Your use of the Site and ANH shall not be responsible for any employment decisions, for whatever reason, made by any entity using the Site.

   You agree that You will not use the Site, including the Database, for any purpose other than as an employer seeking employees. You shall use the Site as provided in these Terms and in any contract You have with ANH. You shall use the Site in accordance with all applicable privacy, data protection and anti-discrimination laws. You agree You shall not further disclose any of the data from the Site to any third party.

   You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained from the Site from loss, misuse, unauthorized access, disclosure, or alteration.

   ANH reserves the right to limit the amount of data, including Profile views and/or searches, that may be accessed by You in any given time period.

   ANH does not make any representations regarding the accuracy or validity of information posted by Users or the appropriateness of this information for evaluation by employers.

3. Additional Terms Applicable to Job Seekers

   Any Profile You submit must be accurate and describe You. You acknowledge and agree that You are solely responsible for the content and accuracy of any Profile, resume or material contained therein, placed by You on the Site. You agree not to place any incomplete, false or inaccurate information on the Site.

4. ANH's Liability

   The Site acts as, among other things, a venue for employers to search for and evaluate job candidates and candidates to post Profiles for job opportunities. ANH is not involved in, and does not control, the actual transaction between employers and candidates. As a result, ANH is not responsible for User content, the quality, safety or legality of the jobs or Profiles posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and ANH makes no representations about any jobs, Profiles, resumes or other User content on the Site. While ANH reserves the right in its sole discretion to remove User content, job postings, Profiles, resumes or other content from the Site, ANH does not assume any obligation to do so and to the extent permitted by law, disclaims any liability for failing to take any such action.

   ANH is not involved in the actual communications between Users. As a result, ANH has no control over the accuracy, reliability, completeness, or timeliness of the Profiles or other Users’ content submitted on the Site and makes no representations about any Profile or User content on the Site.

   Because we do not and cannot be involved in User-to-User dealings or control the behavior of participants on the Site, in the event that You have a dispute with one or more Users, You release ANH (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.

   The Site may contain inaccuracies or typographical errors. ANH makes no representations about the accuracy, reliability, completeness, or timeliness of the Site. The use of the Site is at Your own risk.

5. Disclaimer of Warranty

   TO THE FULLEST EXTENT POSSIBLE BY LAW, ANH DOES NOT WARRANT THAT ANY THE SITE WILL OPERATE ERROR-FREE OR THAT THE SITE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE SITE RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, ANH IS NOT RESPONSIBLE FOR THOSE COSTS. THE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. ANH, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. ANH MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE ANH CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

6. Disclaimer of Damages

   TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL ANH, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON THE SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANH IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Limitation of Liability

   TO THE FULLEST EXTENT POSSIBLE BY LAW, ANH'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SITE OR YOUR USE OF THE SITE, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.

8. Indemnity

   You agree to defend, indemnify, and hold harmless ANH, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User content or other material You provide to the Site, (ii) Your use of any of the Site’s content, or (iii) Your breach of these Terms. ANH shall provide notice to You promptly of any such claim, suit, or proceeding.

9. General

   These Terms are governed by the laws of the State of Alaska, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Anchorage, Alaska. If any provision of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, ANH’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect ANH’s ability to enforce such term at any point in the future. Except as expressly provided in an additional agreement, additional Terms for certain areas of the Site, a particular "Legal Notice," or software license or material on particular pages on the Site, these Terms constitute the entire agreement between You and ANH with respect to the use of the Site. No changes to these Terms shall be made except by a revised posting on this page.
